Summary
In July 2010, Wakefield Metropolitan District Council granted outline planning permission for the erection of four dwellings within the curtilage of an existing dwelling. Spawforths successfully demonstrated that, whilst garden sites no longer fall within the revised definition of previously land contained in PPS3, the site was suitable to accommodate a sustainable residential development.
